Welcome to QuestKeeper! These Terms of Service (“Terms”) govern your access to and use of the QuestKeeper app, website, and related services (collectively, the “Service”). By accessing or using QuestKeeper, you agree to these Terms. If you do not agree, please do not use the Service.

1. Introduction
QuestKeeper (“QK”) is a gamified task management solution designed to help users organize their tasks in a fun and engaging way. By creating an account or using the Service, you agree to comply with these Terms.
2. Eligibility
- Age Requirement: You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use QuestKeeper.
- Parental Consent: If you are under the age of majority, you must have parental consent to use the Service.
- Legal Compliance: You are responsible for ensuring compliance with any local laws that may apply to your use of the Service.
3. Account Registration and Responsibilities
- Registration: Register using a valid email address or a supported OAuth/social login provider.
- Authentication: QuestKeeper uses secure magic links for login; passwords are not stored.
- Security: Keep your email secure to prevent unauthorized account access.
- Account Recovery: Handled through magic links sent to your registered email.
- Account Management: QuestKeeper reserves the right to suspend or terminate accounts for violations of these Terms or unauthorized activities.
- Multiple Accounts: Users are prohibited from creating multiple accounts unless explicitly allowed by QuestKeeper.
4. Technical Requirements
- Supported Platforms:
- iOS: Version 14 or later required.
- Android: Version 12 or later required.
- MacOS: Version 12 or later required. Intel-based Macs are not supported.
- Internet Connection: A stable internet connection is required for app functionality.
- Offline Functionality: There is currently no offline functionality available.
5. Premium Features and Subscriptions
Free Tier
- Spaces: Access to 3 spaces with up to 5 categories per space.
- Tasks: Up to 10 active tasks.
- Notifications: Basic notifications (3 standard, 1 priority per space).
- Customization: Access to 3 basic animal types and backgrounds.
- Gamification: Core gamification features with a 1x points multiplier.
Beta Tier (Limited Availability)
- The Beta Tier is only available to select testers who have been invited to participate in the Beta program prior to the QuestKeeper 1.0 launch.
Pro Tier (Coming Soon)
- Spaces: 10 spaces with enhanced notification limits (5 standard, 3 priority).
- Notifications: Email/phone notifications (limited to 1 each).
- Tasks: Task notifications.
- Gamification: 1.25x points multiplier.
- Customization: Custom themes and achievements.
- Includes: All Beta Tier features.
Subscription Terms
- Pricing: Prices are subject to change with prior notice.
- Renewal: Subscriptions automatically renew unless canceled.
- Cancellation: Users can cancel subscriptions at any time via account settings.
- Refunds: Handled according to platform policies (App Store/Google Play).
- Modification of Features: Features may be modified or enhanced over time.
- Non-Transferable: Premium features are non-transferable and limited to the subscribing account.
6. Public Profiles and User Conduct
- Visibility: Usernames, public profiles, and points are visible to others.
- Profile Pictures: Auto-generated using the user’s Unique User Identifier from the Dicebear API. Users can tweak, but not replace, generated profile pictures.
- User-Generated Content: Users are responsible for the content they post, including tasks, spaces, and other user-generated content.
- Prohibited Conduct:
- Manipulation: Manipulating points or achievements unfairly.
- Automation: Using bots or automation tools.
- Harmful Content: Posting harmful, abusive, or illegal content through usernames, tasks, spaces, or other features.
- Intellectual Property: Violating the rights of others or infringing on intellectual property.
QuestKeeper may moderate, suspend, or terminate accounts to ensure compliance with community standards and maintain the integrity of the Service.
7. Social Features
- Friends List: Functionality allows connecting with other users.
- “Nudge” Feature: Enables automated task reminders between friends.
- Privacy of Tasks: Users cannot directly view others’ tasks or spaces.
- Managing Connections: Friend connections can be removed at any time.
- Public Profiles: Show limited information such as username, points, and achievements.
8. Intellectual Property and Branding
- Ownership: The QuestKeeper name, logo, and brand assets are protected intellectual property.
- Usage Restrictions: Users may not use QuestKeeper branding without written permission.
- Permitted Use: Screenshots of the app for reviews or social media sharing are permitted.
- User Content: User-generated content (tasks, space names) remains the property of the user.
- QuestKeeper Property: AI-generated content and game mechanics are QuestKeeper property.
- Feedback: If you provide feedback or suggestions, you grant QuestKeeper a non-exclusive, royalty-free license to use them for improving the Service.
9. Data Export and Retention
- Active Accounts: Account data is retained indefinitely while the account is active.
- Analytics Data: Follows service provider policies (e.g., Posthog).
- Opt-Out: Users can opt out of Posthog analytics collection.
- Error Tracking Data: Retained for 90 days via Sentry.
- Essential Functionality: Sentry is essential for app functionality and cannot be opted out.
- Session Recording: May include automatic session recording during error events.
- Data Export: Available upon request via email.
- Account Deletion: Requests are processed within 30 days, and data is deleted in accordance with our Privacy Policy.
10. Notifications and Communication
- Essential Notifications: You agree to receive essential account notifications (e.g., login links, account alerts).
- Non-Essential Communications: Can be opted out via account settings or using the unsubscribe link provided in emails.
11. Privacy and Data Usage
- Data Processing: QuestKeeper processes personal data in line with its Privacy Policy.
- Public Data: Only limited data is shared publicly (e.g., usernames, points).
- Data Protection: No personal data is sold to third parties, and no ads are displayed in the app.
- User Rights: Users have rights to access, correct, and delete their personal data as outlined in the Privacy Policy.
12. Disclaimers and Limitation of Liability
- Service Provided “As Is”: QuestKeeper is provided “as is.” We do not guarantee uninterrupted service or error-free functionality.
- No Warranty: We do not provide warranties of any kind, either express or implied.
- Limitation of Liability: To the fullest extent permitted by law, QuestKeeper is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Data Responsibility: QuestKeeper is not responsible for data loss due to user negligence, such as device failure or account deletion. We recommend regularly backing up important task data outside of the app.
13. Termination of Use
- User-Initiated Termination: You may deactivate your account at any time by contacting support@questkeeper.app.
- Data Deletion: Upon account deletion, your data will be removed from our systems within 30 days in accordance with our Privacy Policy.
- Service-Initiated Termination: QuestKeeper reserves the right to suspend or terminate accounts for violations of these Terms or for any activity deemed harmful to the Service or its users.
14. Changes to Terms
- Right to Modify: QuestKeeper may modify these Terms from time to time to reflect changes in our services or legal requirements.
- Notification of Changes: Significant changes will be communicated through email or in-app notifications before they take effect.
- Acceptance of Changes: Continued use of the Service after updated Terms take effect constitutes acceptance of those changes.
- User Responsibility: It is the user’s responsibility to review the Terms periodically for updates.
15. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the United States, State of New Jersey.
- Jurisdiction: Any disputes will be resolved exclusively in courts located within New Jersey.
- Dispute Resolution Process:
- Informal Resolution: You agree to first attempt informal resolution by contacting us at support@questkeeper.app before pursuing legal action.
- Alternative Dispute Resolution: For minor disputes, online dispute resolution platforms may be utilized. Small claims court may be used for disputes within the court’s jurisdiction.
- Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions. This can be waived by sending a written request to QuestKeeper via email within 30 days of accepting these Terms.
16. Third-Party Services
- Integrations: QuestKeeper integrates with third-party services such as Firebase, Supabase, Sentry, Posthog, and others.
- Terms of Use: Your use of these integrations is subject to their respective terms of service and privacy policies.
- Responsibility: QuestKeeper is not responsible for the availability or security of third-party services but takes reasonable measures to ensure integrations function securely within our system.
17. Indemnification
- User Responsibility: You agree to indemnify, defend, and hold harmless QuestKeeper, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.
18. Entire Agreement
These Terms constitute the entire agreement between you and QuestKeeper regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
